GREENE COUNTY, Va. (CBS19 NEWS) -- The delivery driver who took a dog from a family’s front porch pleaded to a lesser charge Wednesday.

"A tiny snippet of video is not going to tell the whole story," Holly Clements said.

The story started Feb. 7 when Clements was caught on video taking a Jack Russell Terrier named Luli and putting it in her work van while she was delivering a package.

"It's been blown way out of proportion," Clements said.

Clements was charged for felony larceny of an animal. Wednesday, she pleaded down to misdemeanor trespassing.

She was sentenced to 10 days in jail with all time suspended, a month of good behavior and a $75 restitution payment to Luli’s owner Alma Garcia.

"I know she deserves something because what she did is not right, but I didn't want her to go to jail. I feel bad that she lost her job," Garcia said.

Clements said it was all a big misunderstanding. She said the dog seemed hungry and unaccounted for, and after offering it treats, it wouldn't leave her alone.

"Hopped in. I threw treats out, she jumped back out, grabbed the treat, hopped back in," she said, "and I didn't feel comfortable pushing it out of the van and leaving him or her there to fend for themselves."

Clements took the dog home and says she was planning to reach out to shelters, but a Greene County Sheriff's Deputy got to her apartment first.

She said she's cared for stray animals many times.

"It appears it is a loved dog, I believe now. At the time the impression I had was that it was not," she said. "Be aware that not everything you do is always interpreted as altruistically as you think or know it is.”

Garcia said she’s satisfied with the outcome of the case and is happy Luli’s home.

"It makes me feel good," she said, “I don't know why she made the decision to take Luli, but hopefully she learned her lesson.”
