FLUVANNA COUNTY, Va. (NEWSPLEX) -- A woman who sued over alleged sexual harassment at the Fluvanna Women's Correctional Center has appealed to the Virginia Supreme Court.
The woman sued an employee at the prison, the state, and the Abacus staffing company over sexual harassment and assault she alleges took place over several months in 2012.
A judge in Fluvanna dismissed the state and Abacus from the suit in November in part because the woman filed her first complaint against the employee after a 30-day deadline for filing administrative complaints had passed. However, that deadline was eliminated soon after.
In the appeal, the woman's attorneys argue that state law gives prisoners additional time to file complaints and lawsuits and that the lower court erred in its dismissal of the defendants.
