UPDATE: Police make arrest in suspicious death along Rivanna Trail

ALBEMARLE COUNTY, Va. (CBS19 NEWS) -- The Albemarle County Police Department says a man has been arrested in connection with a murder near the Rivanna River on Thursday night.

Forty-nine-year-old Allan Ray Via of Charlottesville was arrested Friday night for the death of 24-year-old Cody Jason Cappel.

Police say Cappel was shot multiple times.

His body was found along the trails near the Rivanna River and Peter Jefferson Parkway on Thursday night.

Police say the two men knew each other and were living in tents along the river.

Via is facing charges of second-degree murder and possession of ammunition by a convicted felon.

He is currently being held the Albemarle Charlottesville Regional Jail without bond.


The Albemarle County Police Department says a body was found along the Rivanna Trail on Thursday night, and an investigation is now underway into what is being called a suspicious death.

The body of a man was found around 8 p.m. along the Rivanna River behind Peter Jefferson Parkway.

At this time, there is no word on the man's identity.

On Friday, officers from the U.S. Department of Homeland Security were in the area, though local police officers could not say why they were there.

Police say there is no active threat to the community at this time.

The investigation is ongoing.
