MADISON COUNTY, Va. (CBS19 NEWS) -- One person was killed in a crash in Madison County on Oct. 6.

The Virginia State Police reports the crash occurred around 9:45 p.m. at the intersection of Orange Road and South Seminole Trail.

A 2006 Cadillac DTS was heading west on Orange Road when it failed to stop at a stop sign and crossed South Seminole Trail.

It went straight into an embankment and then hit several trees before coming to a rest.

The driver, identified as 44-year-old Robert R. McCloud of Orange, was taken to the University of Virginia Medical Center with serious but not life-threatening injuries.

A passenger, 56-year-old Steve L. Gallihugh of Madison, died en route to the hospital.

Neither person was wearing a seat belt.

Police say alcohol is being considered a factor in the crash.

The investigation is ongoing and charges are pending.
