CHARLOTTESVILLE, Va. (CBS19 NEWS) -- A Charlottesville judge has denied a motion by one of four men charged in the Aug. 12 beating of Deandre Harris.
The motion asked the court to throw out evidence of Harris' injuries being used in the prosecution of Jacob Goodwin.
Goodwin's attorney, Elmer Woodard, showed video of the assault in court during the hearing and said it shows that Harris sustained his serious injuries before Goodwin became involved in the altercation.
Assistant Commonwealth's Attorney Nina Antony said all participants in the alleged assault are legally responsible for Harris' injuries no matter who directly caused them.
Judge Richard Moore denied the motion.
Goodwin is being held without bond at the Albemarle Charlottesville Regional Jail. His trial begins April 30.
