WASHINGTON (CBS19 NEWS) -- Virginia Senator Mark Warner is reacting to the articles of impeachment against Homeland Security Secretary Alejandro Mayorkas, which are expected to be delivered to the Senate next week.

House Republicans have postponed sending the articles to the Senate until next week, due to concerns over the timing of an impeachment trial that Senate Democrats are expected to quickly move to dismiss.

"We've seen incompetence hit new levels," said Warner. "I spend a lot of time pretty frustrated in this body."

He calls the articles of impeachment "phony."

"Even my Republican Senate colleagues have said they've seen no evidence that Mayorkas committed high crimes and misdemeanors to warrant an impeachment," Warner said. 

House Republicans impeached Mayorkas in February on two articles, claiming he has not been enforcing immigration laws.

They had initially planned to send the articles to the Senate on Wednesday, but some Senate Republicans had been urging House Speaker Mike Johnson to delay the transfer while they try to build more support to block an expected motion from Democrats to dismiss the trial.

"I think this whole charade is an effort to take attention away from the fact the House, led by former President Donald Trump, refused to take up the strong border security bill that was crafted in the United States Senate," Warner said.

That was a bipartisan bill that included funding for border security and aid for Ukraine and Israel. Warner admits the border must be addressed, but he also says the dysfunction in the House is leading to other problems.

"The House leadership failed to have its own Republican members act in any kind of concert, putting in jeopardy the nation's leading national security legislation," said Warner.

The Foreign Intelligence Surveillance Act allows the United States to conduct surveillance on foreign individuals outside the country, according to Warner.

"The idea that the United States would step back from this tool, that expires next Friday, is the height of irresponsibility," he said. "This will rank in my top three of weeks of frustration." 

Senate Majority Leader Chuck Schumer told reporters that Democrats are sticking with their plan to deal with the impeachment as "expeditiously as possible."
