WASHINGTON (CBS19 NEWS) -- A man from Honduras who has been arrested on child sex crime charges in Virginia is now in federal custody.

U.S. Immigration and Customs Enforcement reports Enforcement and Removal Operations Washington, D.C. caught the 30-year-old Honduran national who is accused of sex crimes against a minor.

According to a release, deportation officers arrested him at a residence in Bladensburg, Maryland.

This is not this person’s first arrest, but federal officials say local law enforcement agencies did not honor an immigration detainer that was filed for the suspect.

“This Honduran noncitizen stands accused of some very serious crimes and represented a threat to the children of the Washington, D.C. area,” said ERO Washington, D.C. Field Office Director Liana Castano. “When local jurisdictions have policies in place which prohibit them from cooperating with ICE ERO and from honoring our lawfully issued detainers and administrative warrants, they put the suspects, law enforcement officers, and most importantly, the members of our local communities at risk. ERO Washington, D.C. will continue to prioritize public safety by apprehending and removing the most egregious noncitizen threats from our neighborhoods.”

The man reportedly unlawfully entered the United States on an unknown date and at an unknown location. He was not inspected, admitted or paroled by a U.S. immigration official.

The Honduran was arrested in Fairfax County on July 5, 2023 on charges of carnal knowledge of a child 13-14 years of age: without force.

The ERO Washington, D.C. placed an immigration detainer against the man with the Fairfax County Adult Detention Center on July 6, 2023.

The release says the detention center did not honor that detainer and released the man from custody on a $10,000 bond on July 10, 2023.

The Honduran was then arrested again in Fairfax County on Feb. 22, 2024, and he was charged with two more counts of felony carnal knowledge of a child 13-14 years of age: without force and two counts of felony indecent liberties with a child less than 15 years of age.

Later that day the Fairfax County Adult Detention Center released him from custody, this time before the ERO could file a detainer.

The Honduran national was arrested on April 15 by the ERO Washington, D.C.’s Mobile Criminal Apprehension Team and served with a notice to appear before a U.S. Department of Justice immigration judge.

The man is going to remain in ICE custody pending the outcome of removal proceedings.

The ERO says immigration detainers are filed against noncitizens who are arrested by state or local law enforcement agencies in the United States for criminal activity.

The release explains such detainers are requests from ICE for law enforcement agencies to notify the federal agency as soon as possible before a person who is in this country illegally is released from custody.

Detainers ask state or local agencies to keep the noncitizen in custody for no more than 48 hours beyond the time they would otherwise have been released, letting federal officers take the noncitizen into custody for removal purposes.

The release says these detainers help increase the safety of everyone, including law enforcement, the public and the noncitizen, by allowing for an arrest to be made in a secure setting as opposed to at-large and in the community.

Additionally, the direct transfer into federal custody minimizes a noncitizen’s potential to reoffend and conserves resources by keeping them in law enforcement custody at all times instead of having to search for a person.

The release says the ERO arrested more than 73,800 noncitizens with criminal histories across the country during fiscal year 2023.

At this time, there is no word on whether or not the Honduran will stand trial on the charges in Fairfax County.
